By accessing, browsing, registering for, or otherwise using BookMadeByAI (accessible at bookmadebyai.com, our progressive web application, and associated services, collectively referred to as the "Service" or "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

If you do not agree to these Terms, you must not access or use the Service. To register for an account or publish content, you must be at least 13 years old (or 14 in Québec, or 16 in the European Economic Area). By using the Service, you represent and warrant that you meet this minimum age requirement and have the legal capacity to enter into these Terms.

BookMadeByAI is a comprehensive digital reading, co-creation, and publishing platform that pairs written storytelling with artificial intelligence and multimedia capabilities.

BookMadeByAI provides powerful tools that assist creators in brainstorming, drafting, illustrating, and formatting books using generative AI models.

• Mandatory Creator Review: Generative AI models operate probabilistically. AI-generated text, dialogue, summaries, and imagery may contain factual errors, fabrications ("hallucinations"), logical inconsistencies, unintended similarities to existing materials, or offensive elements. Users remain solely responsible for reviewing, editing, verifying, and approving all content prior to publishing or distributing it.
• No Quality or Uniqueness Warranties: BookMadeByAI does not guarantee that AI-generated output will be unique, factually accurate, original, legally protectable, or free from error.
• AI Provenance & Disclosures: In the interest of literary integrity and reader trust, the platform supports and encourages transparent AI provenance indicators showing the collaborative nature of the work.

BookMadeByAI supports both Fiction and Nonfiction publishing:

• Fiction Works: Novels, short stories, sci-fi, fantasy, mystery, romance, and other creative literary endeavors are understood to be artistic, fictional expressions. Characters, dialogue, and events are products of imagination or creative AI collaboration.
• Nonfiction Works: Biographies, memoirs, histories, pop-science, true crime, technical guides, self-help, and reference books focus on real-world events, people, and topics.
• Independent Verification for Nonfiction: Because generative AI can fabricate realistic-sounding historical events, quotes, scientific assertions, statistics, and citations, creators publishing nonfiction must independently verify all factual claims, quotes, and attributions against reliable primary sources before making their work public.

We strongly champion creator rights:

• Ownership of Original Contributions: Authors retain all copyright, title, and ownership interest in the original human creative contributions they provide, including their original prose, prompts, outlines, story codices, character concepts, selections, structural arrangements, and editorial revisions, to the fullest extent permitted by applicable law.
• No Platform Claim to Your Book: BookMadeByAI does not automatically acquire ownership of your book, story, or manuscript simply because you utilized our platform, tools, or templates.
• Copyright Status of Purely AI Material: The copyrightability and intellectual property protection of purely AI-generated text, art, or audio depends on applicable statutory law and court interpretations in your jurisdiction (such as requirements for human authorship under Canadian, U.S., and international copyright principles). BookMadeByAI makes no warranty regarding the exclusivity or legal protection available for purely machine-generated elements.
• Private Annotations & Notes: Your personal bookmarks, reading highlights, and private margin notes remain your private property.

To operate the platform, store your books, and deliver them to your designated audience, we require a limited technical operational license:

Content created on BookMadeByAI exists in clearly defined visibility states with distinct access implications:

• Public: Published books set to public visibility are discoverable and readable by any platform visitor on public library shelves, reader routes, and your public author profile.
• Private: Books marked private are visible and readable only by you through authenticated preview sessions. They are never shown in public libraries, search results, or public author profiles.
• Draft: In-progress manuscripts, chapter drafts, and autosaved outlines inside your Creator Vault are private and accessible solely by you.
• Testing: Content previewed or generated for experimental evaluation is accessible only within authenticated preview modes and is never displayed publicly.
• Archived (Archiving is NOT Deletion): When an author archives a book, it is removed from public visibility, public shelves, and discovery, but remains preserved in the creator's vault. The author can restore it to active status or delete it permanently.

As a creator, you assume full responsibility for all content and media you submit, generate, or publish through the Service:

• Pre-Publication Due Diligence: Before making content public, you must review and verify that your manuscript and media do not violate third-party rights, including copyright, trademarks, trade secrets, rights of privacy, or rights of publicity.
• No Defamatory or Unlawful Material: You must not publish content that is libelous, slanderous, defamatory, fraudulent, or inciting hate or violence.
• Real People, Historical Figures & Likenesses: If your book references living persons, celebrities, political figures, or other identifiable individuals, you are solely responsible for ensuring you have any necessary releases, permissions, or valid legal basis for using their name, image, portrait, voice, or personal biographical information.
• No Automated Likeness Clearance: BookMadeByAI's AI generation tools and third-party media integrations do not automatically grant or establish likeness rights, model releases, or rights of publicity for any person.
• No Legal Vetting Provided: BookMadeByAI provides publishing and creative tools, not legal advice or intellectual property vetting. We do not certify that any manuscript is legally compliant or cleared of infringement.

To maintain clarity across different types of assets, we explicitly distinguish between:

• User-Owned Content: Original text, uploaded graphics, and personal contributions submitted by authors.
• BookMadeByAI Platform Assets: Platform branding, user interface code, software engines, and curated proprietary soundscapes.
• AI-Generated Assets: Text, images, or audio generated dynamically via integrated AI inference models.
• Third-Party Licensed Media: Media sourced through external repositories, including Pixabay, Wikimedia Commons, and Flickr, as well as embedded YouTube videos and Wikipedia references.

Media obtained through external providers remains subject to the respective provider's license and terms (e.g., the Pixabay Content License, Creative Commons licenses, or Public Domain declarations). BookMadeByAI does not claim ownership over third-party assets, and users are responsible for complying with any applicable license terms and attribution requirements.

Our generative AI tools and interactive reading features ("Ask AI") are powered by advanced machine learning models:

• Probabilistic Nature: AI models generate responses by identifying statistical patterns in text. Output may occasionally be incorrect, contradictory, or unexpected.
• Reader Companion Scope: The "Ask AI" interactive companion is designed for literary enrichment, contextual exploration, and character discussion. Responses are generated dynamically and do not constitute authoritative factual, historical, legal, medical, or financial advice.
• Non-Endorsement: Statements, dialogue, or viewpoints generated by AI characters or models do not reflect the opinions, beliefs, or endorsements of BookMadeByAI.

You agree to use BookMadeByAI responsibly and lawfully. You agree NOT to:

1. Generate, upload, or publish content that is illegal, sexually explicit, abusive, harassing, defamatory, promoting terrorism, or infringing third-party rights.
2. Bypass or attempt to circumvent content moderation filters, safety guardrails, or rate limits.
3. Scrape, crawl, harvest, or extract books, data, or manuscripts from the platform using automated tools without prior written permission.
4. Reverse-engineer, decompile, or disassemble platform software or proprietary sound systems.
5. Interfere with platform integrity, introduce malware, or disrupt service operations.
6. Impersonate any person or entity or misrepresent affiliations.

The BookMadeByAI brand name, logo, site architecture, user interface design, visual styling, software codebase, proprietary ambient audio algorithms, and platform-created assets are the exclusive intellectual property of BookMadeByAI and are protected by applicable trademark, copyright, and trade secret laws.

We do not claim exclusive ownership over third-party licensed media, user-owned original contributions, or public domain materials accessible on the Service.

To provide state-of-the-art capabilities, BookMadeByAI continually refines its technical architecture. We reserve the right to add, update, modify, replace, or discontinue AI model architectures, AI inference providers, media integrations, or platform features at any time without notice and without requiring the permanent listing of any specific third-party provider in these Terms.

BookMadeByAI currently provides certain features at no charge, including the creation and publishing features described by "Free to create. Free to publish." That message describes the current offering and is not a promise that every feature or service will remain free indefinitely.

We may introduce optional paid features or services in the future. Depending on what we offer, these could include subscriptions, premium features, usage-based services, additional AI capabilities, increased limits, storage, publishing-related services, marketplace services, or other paid offerings. We have not selected a long-term monetization model.

Before you purchase or use an applicable paid service, we will clearly disclose its pricing, fees, billing terms, and any other charges. You will not be charged without your authorization. Introducing a paid service will not retroactively create charges for services you previously used for free.

Creators maintain full operational autonomy over their content within the platform:

• Archiving: You may archive any book from your vault to remove it from public circulation while keeping the draft safely preserved.
• Content Deletion: You may delete individual drafts, scenes, or published books from your Creator Vault at any time.
• Account Deletion: You may initiate permanent account deletion from your account settings, which deletes your profile, credentials, manuscripts, notes, and reading history from active platform databases.
• Technical Retention: Deletion removes records from active production databases; residual backup snapshots cycle out in accordance with standard disaster recovery timelines, or as strictly necessary to fulfill legal obligations.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, or freedom from errors or interruptions.

To the maximum extent permitted by applicable law, BookMadeByAI, its operators, affiliates, directors, officers, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or creative opportunities, arising from your use of (or inability to use) the Service or any AI-generated content.

These Terms of Service and any dispute arising out of or related to your use of BookMadeByAI shall be governed by and construed in accordance with the laws of the Province of Québec and the federal laws of Canada applicable therein, without giving effect to conflict of law principles.

Except where prohibited by applicable consumer protection legislation, any legal action or proceeding arising out of these Terms shall be instituted exclusively in the competent courts located in the judicial district of Montréal, Québec, Canada.

We may revise these Terms of Service from time to time. When modifications occur, we will update the "Last Updated" date at the top of this page. Your continued use of the Service following published updates constitutes your binding acceptance of the revised Terms.
